State action

On October 2, 2026, a federal judge granted in part, and continued in part, preliminary-injunction requests by Kalshi, Coinbase, the United States, and the CFTC against Illinois officials. The opinion says Illinois licensing rules and a related criminal provision aimed at sports wagers are likely preempted.

It left for more briefing a transaction fee on an “exchange wager,” which the opinion describes as a contract on a prediction market tied to a sporting contest or sporting event, at 1.75% on the first five million such wagers in a fiscal year and 3.5% after that.

The opinion also recounts that Illinois sent a cease-and-desist letter after Kalshi began listing sports contracts. The ruling is not final. That scope is sports. Other markets stay on this snapshot’s Available note.
