Utah Code § 76-9-1401, effective May 6, 2026, says gambling includes a proposition bet: “a gambling bet on an individual action, statistic, occurrence, or non-occurrence.” Gambling does not include a lawful business transaction.

On August 4, 2026, the U.S. District Court for the District of Utah held that the Commodity Exchange Act does not preempt Utah’s enforcement of its anti-gambling laws against Kalshi. The case concerned sporting event contracts. That scope is sports contracts.

On September 8, 2026, the Tenth Circuit denied Kalshi an injunction pending appeal and did not decide the appeal, so there is federal-versus-state uncertainty. An operator listing the state does not change the state law.

On October 20, 2026, the Utah Attorney General sued KalshiEX LLC and related entities in Utah state court. The office says the complaint alleges that Kalshi lets Utahns bet on sports, elections, politics, and other outcomes in violation of Utah’s gambling laws, and asks the court to stop Kalshi from offering these bets in Utah. It is a complaint, not a ruling.
